In this Health Savings Account (HSA) Debit Card Agreement ("Agreement") the following definitions will apply: The words "you" and "your" refer to the holder of the MasterCard® or Visa® HSA Debit Card ("Card") issued through SouthState Bank, N.A. The words "we", "us", and "our" refer to SouthState Bank, N.A. ("SouthState"). "Fee" means any service charge, or other charge or fee charged to the Card by SouthState. References to Card usage, include references to such usage whether through physical presentment at a Point of Sale (POS), providing the Card number over the phone, internet or otherwise, and/or using the Card's Personal Identification Number (PIN), whether such usage is made by you or someone you allow to make such usage. The words "Designated Account" refers to the SouthState Bank Health Savings Account linked to the Debit Card governed by this Agreement. "Business days" are Monday through Friday, not including Federal Holidays.
HSA Debit Card Acceptance
By using the Card, you agree to be bound by this Agreement, as well as any other agreements, disclosures, rules, or notices relating to the Card as may be posted on SouthState's website or otherwise made available to you, as applicable, and as amended from time to time. If you do not agree to be so bound, you must not use the Card, and you must destroy the Card and dispose of it. If your Health Savings Account(s) is a family account, each accountholder may exercise any and all rights under this Agreement individually and all accountholders will be jointly and severally liable for the obligations incurred by any such exercise. Any accountholder may use the Card, may agree to any amendment to or termination of this Agreement, may close any Designated Account, and in the event that any such action is taken, such action will be binding upon each accountholder.
Activation & Use
Your Card cannot be used until it is activated.
- You can activate your Card by calling the number on the sticker affixed to the front of your Card or provided on the Card insert.
- You may select your Personal Identification Number (PIN) during the activation call.
- If you activate your Card, you agree to sign it upon such activation.
- It is a requirement of SouthState Bank that you provide a working phone number in order to have a Debit Card.
- To keep the Card activated, you must maintain in good standing the Health Savings Account linked to the Card.
Ownership; Card Cancellation
The Card remains property of SouthState. SouthState can revoke your right to use the Card at any time, with or without cause and with or without notice. You may cancel your Card at any time by writing us at the address provided in your Account statement. You must surrender the Card to SouthState upon request. If your Card is cancelled, you are responsible for any card transactions made before the Card is cancelled.
Use Restrictions
Your privileges may be withdrawn by SouthState upon default, suspension, or termination of the Card Account or the Designated Account. Use privileges may also be limited or withdrawn by SouthState at any time with or without cause and with or without notice. You agree that your Card will not be used for any illegal transactions. It is your responsibility to determine if your usage is legal. You may not use your Card in connection with any Internet or on-line gambling transaction, even if gambling is legal in the jurisdiction where the activity took place. We are not responsible for your losses from gambling or illegal activity or otherwise. You agree that you will not use the Card to transfer money to or from accounts over which you do not have authority. You acknowledge that SouthState provides the Card as an accommodation only and, except as otherwise expressly provided by law or herein, SouthState is not responsible for the manner in which the Card is used.
Daily Limits
You may use your Card subject to the limits set forth herein.
Purchases - PIN or Signature based purchases made using your Card are limited to $2,500.00 per day. You may use your Card to make PIN or signature-based purchases wherever debit cards are honored for qualified medical expenses only. Qualified medical expenses are described in Section 213(d) of the Internal Revenue Service Tax Code.
ATM Withdrawals/Cash Advances - HSA Debit Cards do not allow ATM withdrawals.
We may, without telling you, increase your daily purchase limit based on account history, activity, and other factors. If we decrease the limits of your Card, we will notify you in accordance with applicable law.
You may request modifications to these limits, which we may grant or deny at our sole discretion. We may impose additional restrictions or limitations at any time with or without cause and with or without notice. All transactions or limits are also subject to the amount of available funds in the Designated Account. Some merchants or networks may have limits which are lower than our limits.
How to Use Your Card
- Purchases: You may use your Card to make PIN or signature-based purchases wherever debit cards are honored for qualified medical expenses only. Qualified medical expenses are described in Section 213(d) of the Internal Revenue Service Tax Code. The expenses must be primarily to alleviate or prevent a physical or mental defect or illness, including dental and vision.
- Pay for services through merchants who have agreed to accept the Cards and provide services that are qualified medical services.
- Pay qualified medical bills.
Transactions made on the Cards and any Fees charged to the Card Account will be immediately deducted from the attached Account. The Designated Account will also continue to be governed by the applicable depository and/or checking account agreements to the extent such agreements are not inconsistent with this Agreement.
Transaction Records and Periodic Statements
You can receive a receipt for point-of-sale transactions. You will get a monthly statement.
Card Transaction Preauthorization
Any preauthorized amount will place a "hold" on your available funds until the merchant submits the final payment amount of your purchase. Once the final payment amount is received, the preauthorized amount on hold will be removed. It may take up to three (3) days for the hold to be removed. During the hold period, you will not have access to the preauthorized amount.
Stop Payment
You may not stop payment on a point-of-sale transaction. You may stop payment on a recurring transaction by notifying us at least three business days before the transaction is scheduled to post. Please call 1-800-277-2175 or write to us at SouthState Bank, Electronic Banking Department, Post Office Box 118068, Charleston, South Carolina, 29423. We reserve the right to charge you a fee for each stop payment order and each renewal of a stop payment order. Refer to the Personal Account Fee Schedule for the cost of the stop payment.

International Transactions
If you make a purchase in a foreign country, from a foreign merchant or which is routed through a foreign bank you may be subject to a foreign transaction fee. This may also occur if the transaction is in a currency other than the U.S. Dollar (USD). Foreign currencies will be converted to U.S. Dollars at the exchange rate determined by Visa USA, Inc. or MasterCard using their currency conversion procedures. The currency conversion rate used on the conversion date may differ from the rate in effect on the date you used your Card. A conversion international transaction charge will be charged to the Card. In addition, an International Transaction Fee will be charged if such transaction was in U.S. Dollars but charged by a merchant who is outside of the U.S.
Visa Account Updater and MasterCard Automated Billing Updater
Debit Cards are automatically enrolled in either the Visa Account Updater (VAU) or MasterCard Automated Billing Updater (ABU) service, depending on the Card logo on the front of your debit Card. When your Card is reissued or closed, Visa/MasterCard will securely provide updated debit card information to participating merchants with whom you have a recurring payment(s) established to ensure payment continuity and uninterrupted service. However, you have the right to opt-out of this service. To opt-out of the VAU/ABU service, please contact us at 1-800-277-2175 or visit your local branch. While opted-in to this service, it is not guaranteed that all merchants participate in VAU/ABU, therefore, you should contact merchants with whom you have recurring payments to confirm your debit Card information has been updated in order to ensure payments are not interrupted. Updates are not guaranteed; SouthState is not responsible for late, missed, or recurring payments. If you are currently opted-out of the VAU/ABU service, you will be responsible for providing your new Card information to merchants with whom you have recurring payments. You may incur additional fees from your merchants if you do not provide updated information in a timely manner.
Default
Your Card will be in default, and we may terminate any or all Cards if: (i) you fail to comply with this Agreement or you fail to comply with any agreement with SouthState; (ii) a petition for bankruptcy, insolvency, receivership, or similar protection is filed by or against you; (iii) you die or become incapacitated; or (iv) we decide, in our sole judgment, to cancel the Card(s). This does not limit our right to terminate your Card or the Card Account privileges as otherwise provided in this Agreement. If we sue to collect amounts due us hereunder, you will pay our reasonable expenses, including reasonable attorneys' fees, to the extent permitted by applicable law.
Notices
We will send statements and any other notices to you at the address showing in our files. You agree to inform us promptly of any change in address. We may, in our discretion, accept address corrections from the U.S. Postal Service. If you have a dispute with us, be advised that contacting us verbally may not preserve your rights. For accounts with more than one owner, we may send notice to any one co-owner. A notice sent to any one owner is effective notice for all.
Liability for Unauthorized Use
You assume responsibility for all transactions arising from authorized use of the Card by any User, whether such use is with an banking terminal, electronic funds transfer device, any debit program or any other means of access. If you have authorized another person to use the Card in any manner, that authorization shall be deemed to include the authorization to make withdrawals or transfers of funds to or from the Account, and such authorization shall be deemed to continue until you have taken all steps necessary to revoke it by preventing such use by that person, including, without limitation, notifying the User and contacting us to inform us that the User is no longer authorized. You agree to assist us in determining the facts, circumstances, and other pertinent information related to any loss, theft, or possible unauthorized use of your Card, Account Number or PIN and to comply with such procedures as we may require in connection with our investigation.
In Case of Errors or Questions
In case of errors or questions about your transactions, call 1-800-277-2175 or write us at SouthState Bank, eClaims Center, Post Office Box 118068, Charleston, South Carolina 29423, as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transaction listed on the statement or receipt. We must hear from you no later than 60 days after we sent (or first made available to you) the FIRST statement on which the problem or error appeared. We will attempt to answer your questions and correct any errors promptly. We will have a reasonable period of time to investigate the circumstances surrounding any claim of loss and we may but are not required to provisionally credit your account during our investigation.
Zero Liability Protection
Your Debit Card comes with Zero Liability protection for unauthorized transactions that you report promptly to us. With Visa or MasterCard Zero Liability protection, if your Card is ever lost or stolen or used without your permission, you must tell us immediately. If you do, you will not be responsible for unauthorized transactions made using your Card or Card number.
- If you notify us about any unauthorized transaction(s) within 60 days of when the first account statement showing the unauthorized transaction(s) was sent or made available, you will be protected for your losses on the account.
- If you notify us about any unauthorized transaction(s) after the 60-day timeframe stated above, we may not reimburse you for the unauthorized transaction(s). You may be required to provide documentation to support your claim, including an affidavit of unauthorized use and a police report. In addition, we may consider whether any negligence on the part of the cardholder has contributed to any transaction(s) in question.
The following are not considered to be unauthorized transactions under the Zero Liability protection, which means you are liable for any transaction:
- Made or initiated by you or any person you have authorized to use your card, even if that person has exceeded the authority you gave;
- A merchant has processed in error, or if you are unhappy with goods or services you purchased. In these cases, first contact the merchant to resolve the situation.
Zero Liability protection applies to purchases made in-store, online, by telephone or via mobile device. Coverage for PIN-based transactions may vary depending on the card network and how the transaction was processed. For example, Visa Zero Liability does not apply to any PIN-based transaction not processed by Visa.
Loss or Theft of a Card or PIN
You agree to promptly notify us in the event any Card or PIN is lost or stolen, or you suspect any other unauthorized use of any Card or PIN. IN NO EVENT SHALL ANY USER WRITE THE PIN ON A CARD OR KEEP ANY WRITTEN RECORD OF IT ON ANY MATERIAL KEPT WITH A CARD.
If you believe your debit Card, and/or Card account number has been lost or stolen, you agree to notify the Bank immediately by:
- Calling us at 1-800-277-2175;
- Writing us at: South State Bank Card Services, P.O. Box 118068, Charleston, South Carolina, 29423; or
- Contacting us through Online Banking's secure messaging.
Fraud Protection
We use fraud prevention systems to monitor your debit Card activity for fraud and unusual activity and may notify you of any potential suspicious activity using the contact information we have for you in our records, including your telephone number and email address. If we are unable to reach you to verify any such suspicious activity, we may prevent further suspect activity by not authorizing further transactions until you validate the suspicious transactions. To be certain that we reach you quickly, please make sure we have your updated contact information. In the event of notice of a compromised merchant or area, we may, find it necessary to restrict or block debit card use in certain countries, areas or at certain merchants from time to time without prior notice to you. If you attempt to use your Card as a signature-based transaction (e.g., you select "credit Card") and it is blocked, retry your purchase as a Pin-based transaction (e.g., select "debit card"). For security reasons, we cannot disclose the details of our fraud prevention procedures. If we are notified that your Card data has possibly been compromised by one of our security partners, we may choose to notify you and not authorize further transactions on the Card.
Inactive Debit Cards
In an effort to minimize debit card fraud, the Bank may choose to close any Card that has had no activity for the preceding eighteen (18) months. If a debit card has been inactive for over 18 months we may choose to not reissue the Card when it reaches its expiration date. If you need a replacement Card, please contact us at 1-800-277-2175.
Use of Your Telephone Number
When you provide your telephone number to us, you are authorizing us to place calls to you at that number. This applies to both land line phone numbers and cell phone numbers. "Calls" include both telephone calls and text messages to or from your phone or cell phone. As an example, we may place calls/texts to you about fraud alerts, deposit holds, or amounts you owe us (collection calls) on your account. By providing us with a telephone number for a cellular phone or other wireless device, you are expressly consenting to receiving communications, including but not limited to, prerecorded or artificial voice message calls, text messages, and calls made by an automatic telephone dialing system, from us and our affiliates and agents at that number. This express consent applies to each such telephone number you provide to us now or in the future and permits such calls regardless of their purpose. Calls and messages may incur access fees from your cellular provider. By maintaining an account with us, you are authorizing us to monitor and record telephone conversations you have with us for reasonable business purposes. We will not remind you that we may be monitoring or recording a call at the outset of the call, unless required by law to do so.
No Waiver
The Bank may exercise its rights under this Agreement immediately or, at the Bank's sole discretion, may delay enforcing or decline to enforce any of its rights without losing, waiving, or impairing them.
Amendments
We can amend the terms of this Agreement at any time. We will notify you of what these amendments are. Subject to the requirements of applicable law, any amendments to this Agreement will become effective at the time stated in our notice. Use of the Card after the effective date of the amendment constitutes acceptance of the amendment. You will have no right to amend this Agreement.
Confidentiality
We will disclose information to third parties about your account or the transactions you make in order to process transactions or otherwise perform our obligations under this Agreement, to verify the existence and condition of your account for a third party (such as Credit Bureau or merchant), or to comply with government agency or court orders, or if you give us your written permission.
Interpretation of This Agreement
This Agreement shall be governed by and be construed in accordance with the laws of the United States and the state of Florida, where the headquarters for the Bank issuing the Card is located, regardless of where you may reside or use your Card at any time. The headings used in this Agreement are for convenience only and shall have no bearing on the interpretation on of this Agreement. The provisions of this Agreement are severable to the extent that any provision hereof held to be prohibited or unenforceable in any jurisdiction shall not invalidate the remainder of this Agreement in that jurisdiction and shall be fully enforceable in any other jurisdiction not expressly prohibiting such provision.
Disclaimer
SOUTHSTATE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES PROVIDED TO YOU WITH RESPECT TO THIS AGREEMENT, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. ALL SOUTHSTATE SERVICES ARE PROVIDED "AS IS," "WHERE IS" AND WITHOUT RECOURSE TO SOUTH STATE.
Limitation of Liability
TO THE EXTENT SUCH LIMITATION OF LIABILITY IS PERMITTED BY LAW, (I) SOUTHSTATE WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES OR LOSSES, WHETHER OR NOT FORESEEABLE, (II) SOUTHSTATE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING DIRECTLY OR INDIRECTLY FROM OR IN CONNECTION WITH ANY INACCURACY, ACT OR FAILURE TO ACT ON THE PART OF ANY PERSON NOT WITHIN OUR REASONABLE CONTROL, OR ANY ERROR, FAILURE, OR DELAY IN EXECUTION OF ANY TRANSACTION RESULTING FROM CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL, INCLUDING, BUT NOT LIMITED TO, ANY INOPERABILITY OF COMMUNICATIONS FACILITIES OR OTHER TECHNOLOGICAL FAILURE, AND (III) SOUTHSTATE WILL NOT BE LIABLE FOR ANYTHING EXCEPT FOR ITS OWN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. PROVIDED WE HAVE COMPLIED WITH OUR OBLIGATIONS UNDER THIS AGREEMENT, AND SUBJECT TO APPLICABLE LAW, YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD SOUTHSTATE HARMLESS AGAINST ANY THIRD PARTY CLAIM ARISING FROM, OR IN CONNECTION WITH, DIRECTLY OR INDIRECTLY, YOUR USE OF ANY CARD, THIS AGREEMENT, OR ANY RELATED SERVICE WE PROVIDE.
Entire Agreement
This Agreement, along with the agreement(s) regarding the Designated Account, is the entire agreement between the parties hereto regarding the subject matter, and supersedes any oral agreements, oral representations, or oral warranties relating thereto.
